What is risk management?

In a general sense, risk management is any activity that reduces the likelihood of loss. Any activity that prevents loss is a type of risk management. And there are many ways in which risk management protects individuals and organizations from loss. If you wear boots on an icy day, you are preventing damage to your shoes and you are reducing risk that you might slip and fall, injuring yourself. From a business perspective, you might transfer risk by purchasing fire insurance; this engages another party to assume your risk and it allows you to be able to predict your expenses and spread them over time and over the number of other insured parties. In a clinical sense, risk management helps you understand where the losses are occurring that result in professional liability lawsuits. As the oldest healthcare professional liability insurer, Medical Protective analyzes closed claims, extrapolates data from its risk management teams' reports, monitors professional and government actions that impact healthcare-and uses this information to inform, educate, and, in some instances, warn physicians, dentists, and healthcare organizations about traditional as well as emerging risk issues.

How does risk management protect me from liability?

Medical Protective has dedicated its risk management expertise exclusively to the healthcare professions for over 100 years. In that time it has become increasingly clear that poor outcomes and lawsuits are often triggered by poor communication. These risks include: a) doctor and patient don't have the same expectations; b) the patient was not fully informed of the risks or benefits of treatment options; c) the patient didn't feel any sense of obligation about complying with the treatment plan; d) important information was not sent or transmitted in ways that ensured the progress and success of the patient's treatment; e) the doctor and patient didn't have an effective working relationship.

Traditionally, the healthcare professional has been considered the caption of the patient's care, solely accountable for the success or failure of the treatment. In fact, many other individuals and entities participate in the patient's care - and the number of these participants, including technology, will continue to increase. No doctor can stay on top of every aspect of a patient's care, regardless of how knowledgeable and dedicated he or she may be.

Risk management reduces liability by helping doctors understand that communication processes and business practices are more often the causes of patient injuries than actual negligence on the part of the practitioner. Risk management helps doctors reduce liability through: a) more effective communication skills; b) better working relationships within their own teams and with other health care providers; and c) consistency in the way that clinical processes occur. Medical Protective assumes the role of identifying key learning factors. It also focuses on education that is pragmatic in a world that is short on time and money.

Risk management education helps reduce liability but there are no guarantees that it can always prevent a lawsuit. However, it has played a significant role in the doctors' ability to win lawsuits-contributing to the company's trail win rate of 93%.
